In the alternative, Plaintiff will move before a judge of this Circuit on the 10th day after service  hereof, or as soon thereafter as counsel may be heard, for an Order enforcing the assignment of rents, if any, and compelling payment of all rents covered by such assignment directly to the Plaintiff, which motion is to be based upon the original note and mortgage and Complaint attached hereto.

Complaint
 Plaintiff, by and through his undersigned counsel of record, will prove unto this honorable Court the following:
GENERAL ALLEGATIONS
 1. Plaintiff Has A. Shah (hereinafter "Plaintiff") is a citizen and resident of Spartanburg County, South Carolina.
 2. Defendant Cassandra Yvette Sherred (hereinafter "Defendant) is, upon information and belief, a citizen and resident of Spartanburg County, South Carolina.
 3. The collision giving rise to this lawsuit occurred in Spartanburg County, South Carolina.
 4. On or about December 2, 2008 at approximately 11:30 a.m. Plaintiff was traveling east on SC 296 in his 1996 Nissan Maxima automobile approaching a green traffic light.  Defendant, traveling opposite of Plaintiff in her 1997 Honda automobile, failed to yield right of way to Plaintiff and turned left into the driver's side front quarter panel of Plaintiff's automobile.       
 5. As a direct and proximate result of the collision Plaintiff suffered injuries and damages as set forth hereinbelow.  
PLAINTIFF'S CAUSE OF ACTION
(NEGLIGENCE)
 6. The foregoing allegations contained in this Complaint are incorporated by reference herein as fully as if restated ver- batim.  
 7. Defendant was negligent, grossly negligent and reckless in the following particulars, to wit: 
 (a) in failing to keep a proper lookout;
 (b) in failing to keep the vehicle under proper control so as to avoid the collision;
 (c) in driving too fast for conditions then and there existing;
 (d) in failing to safely and properly apply brakes so as to stop the vehicle and avoid the collision;
 (e) in failing to yield the right of way;
 (f) in generally failing to exercise the degree of care and caution that a reasonably prudent person would have exercised under the circumstances then and there existing; and
 (g) In violating the statutory and common laws regarding the operation of motor vehicles within the State of South Carolina.
 8. As a direct and proximate result of the aforementioned acts of negligence, gross negligence and recklessness on behalf of Defendant, Plaintiff suffered injuries to his person, including injuries to his right eye, knee and shoulder that required expensive and extensive medical care and treatment. 
 9. As a further direct and proximate result of the aforementioned acts and/or omissions of Defendant, Plaintiff suffered physical pain and the loss of enjoyment of life.
 WHEREFORE, Plaintiff prays for judgment against Defendant for actual and punitive damages, for the costs of this action, and for such other and further relief as the Court deems just and proper.
