 YOU ARE HEREBY NOTIFIED that you have been sued by the Plaintiff in the Court indicated above. You are hereby SUMMONED and required to answer the attached Complaint in this action, a copy of which is hereby served upon you, and to serve a copy of your Answer upon the undersigned attorney at his office at 240 Magnolia Street, Spartanburg, South Carolina 29306, within thirty (30) days after service of this Summons upon you, hereof, and if you fail to do so, you are hereby notified that judgment by default will be rendered against you for the relief demanded in the Complaint.

Amanda Dube, Plaintiff,
vs.
Godwin Dube, Defendant.
Complaint
 1. The Plaintiff is a citizen and resident of Spartanburg County, South Carolina and has been so for over one year. 
 2. Upon information and belief the Defendant resides in the country of Australia. 
 3. The parties were married on February 16, 2011, last resided together in Spartanburg County, South Carolina, separated on November 5, 2024 and have continuously lived separate since.
 4. Three (3) children were born of the marriage; E.D. (born in 2006 and emancipated), M.D. (born in 2013), G.D. (born in in 2012) and no others are expected. 
 5. The minor children have resided solely with the Plaintiff who has been and continues to be their sole provider and caregiver.
 6. At the time the parties in this action were married on February 16, 2011, the Defendant was legally married to Sherry Lynn Long a/k/a Sherry Lynn Dube.
 7. The Defendant and Sherry Lynn Long a/k/a Sherry Lynn Dube were married on January 7, 2001 in the State of North Carolina (said ‘North Carolina Application, License, and Certificate of Marriage’ attached to this Complaint).
 8. The Defendant and Sherry Lynn Long a/k/a Sherry Lynn Dube were granted a Judgment of Divorce in the General Court of Justice, District Court Division, County of Mecklenburg, State of North Carolina, on April 6, 2011 (said North Carolina Judgment attached to this Complaint).
 9. The Plaintiff requests the Court issue an Order declaring the parties’ marriage void pursuant to S.C. Code Section 20-1-80 and S.C. Code Section 20-1-530 of the South Carolina Code of Laws.
 10. The Plaintiff requests the Court issue an Order declaring the children of the voided marriage legitimate, pursuant to S.C. Code Section 20-1-90 and afford them the same legal rights as children born in lawful wedlock.
 11. The Plaintiff is informed and believes that she is entitled to sole custody of the parties’ minor children, as she has been and continues to be the sole provider and caregiver for said children.
 12. The Plaintiff requests the Court issue an Order changing her surname to her maiden name.
 13. The Plaintiff requests the Court issue an Order awarding her attorneys fees and costs.
