TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Master in Equity, at conclusion of the bidding, five percent (5%) of its bid, in cash or equivalent to be applied to the purchase price in case of compliance, but in the case of non-compliance to be forfeited and applied first to the costs of sale and the balance of Plaintiff’s debt. If the highest bidder fails to comply with the bid within thirty (30) days, the Master in Equity may re-sell the property on some subsequent sales day.
No personal or deficiency judgment being demanded, the bidding shall be final on the sale date, and the successful bidder may comply immediately.
The successful bidder shall pay all costs associated with recording the deed. The successful bidder will pay interest on the balance of the bid from sale date to compliance date at the rate of 3.125%. The sale shall be subject to taxes, assessments, easements and restrictions of record, and any senior encumbrances. The Defendant United States of America, acting by and through its Agency, The Secretary of Housing and Urban Development, waived in writing any federal right of redemption under 28 U.S.C. § 2410(c).
If an agent of Plaintiff does not appear at the sale, the property shall be withdrawn and sold at
