ALL THAT CERTAIN PIECE, PARCEL OR LOT OF LAND, LYING AND BEING SITUATE IN THE STATE OF SOUTH CAROLINA, COUNTY OF SPARTANBURG, BEING SHOWN AND DESIGNATED AS 0.841 ACRES ON THAT SURVEY PREPARED FOR CARRINGTON MORTGAGE SERVICES, LLC, BY MCDANIEL LAND SURVEYING, LLC, DATED JANUARY 7, 2025, AND RECORDED MARCH 25, 2025, IN PLAT BOOK 186 AT PAGE 983 IN THE OFFICE OF THE REGISTER OF DEEDS FOR SPARTANBURG COUNTY. SAID PLAT BEING INCORPORATED HEREIN BY THIS REFERENCE FOR A MORE COMPLETE AND ACCURATE DESCRIPTION.
ALSO INCLUDED HEREWITH IS AN EASEMENT FOR ACCESS OVER THAT CERTAIN “NEW 20’ ACCESS EASEMENT” SHOWN ON THE PLAT REFERENCED ABOVE.
THIS BEING THE SAME PROPERTY CONVEYED TO RANDOLPH LOWERY, JR., AND MILDRED G. LOWERY BY DEED OF ANNIE MAE LOWERY DATED JULY 20, 1965, AND RECORDED SEPTEMBER 27, 1965, IN BOOK 31-T AT PAGE 82 IN THE OFFICE OF THE REGISTER OF DEEDS FOR SPARTANBURG COUNTY, SOUTH CAROLINA, COMBINED WITH THE SAME PROPERTY CONVEYED TO RANDOLPH LOWERY BY DEED OF ANNIE MAE LOWERY RECORDED SEPTEMBER 22, 1965, IN BOOK 31S AT PAGE 455 IN SAID RECORDS. THEREAFTER, RANDOLPH LOWERY, JR., CONVEYED HIS INTEREST IN THE PROPERTY TO MILDRED G. LOWERY BY DEED DATED APRIL 8, 1969, AND RECORDED MAY 6, 1969, IN BOOK 35-T AT PAGE 171 IN SAID RECORDS AND TO RANDOLPH LOWERY, JR., AND MILDRED G. LOWERY BY DEED DATED FEBRUARY 4, 1981, AND RECORDED FEBRUARY 9, 1981, IN BOOK 47-Z AT PAGE 300 IN SAID RECORDS. SUBSEQUENTLY, MILDRED G. LOWERY CONVEYED HER INTEREST IN THE SUBJECT PROPERTY TO RANDOLPH LOWERY, JR., BY DEED DATED APRIL 2, 1991, AND RECORDED APRIL 2, 1991, IN BOOK 57-P AT PAGE 295 IN SAID RECORDS. THEREAFTER, RANDOLPH LOWERY, JR., DIED ON NOVEMBER 1, 2023, LEAVING THE SUBJECT PROPERTY TO HIS HEIR/DEVISEE, MELVIN LOWERY, AS IS MORE FULLY PRESERVED IN PROBATE FILE NO. 2025-ES-42-00088 IN SAID RECORDS.

TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Master In Equity, at conclusion of the bidding, five percent (5%) of its bid, in cash or equivalent to be applied to the purchase price in case of compliance, but in the case of noncompliance to be forfeited and applied first to the costs of sale and the balance of Plaintiff’s debt. If the highest bidder fails to comply with the bid within thirty (30) days, the Master In Equity may re-sell the property on some subsequent sales day.
No personal or deficiency judgment being demanded, the bidding shall be final on the sale date, and the successful bidder may comply immediately. The successful bidder shall pay all costs associated with recording the deed.
The successful bidder will pay interest on the balance of the bid from sale date to compliance date at the rate of 2.448%. The sale shall be subject to taxes, assessments, easements and restrictions of record, and any senior encumbrances.
If an agent of Plaintiff does not appear at the sale, the property shall be withdrawn and sold at the next available sales date upon the same terms and conditions.
